Q. I am a licensee of a public house in Ocean Road, South Shields and also an all night take-away shop in Jarrow. I have read that the licensing laws are changing. Will this affect me?
A. Yes very much so. The Law changed on the 7th February 2005 and you have until November to apply for a new licence for both your public house and your all night take-away otherwise you will not be able to trade.
Q. What do I need and how do I obtain this?
A. You will need a Personal Licence for yourself as Licensee for your public house and a Premises Licence also. These are obtained from the Town Hall and not the Magistrates' Court as in the past. You will need to show that you can comply with the South Tyneside Council policy on licensing which includes the protection of children from harm, the prevention of public nuisance, crime and disorder and public safety. For the first time ever you will need a licence for your all night take-away shop and you must satisfy the Licensing Committee at the Town Hall that you comply with their policy. If you don't, then you will be breaking the law from November and will not be able to trade.
Q. Can I complete the forms myself?
A. Yes, but they are quite complex and you have to make sure you comply with the South Tyneside policy. It is recommended that you take legal advice on the forms and the procedure.
