Houses in Multiple Occupation - 27.03.06

Q. I have two properties which are let to students from South Shields Marine & Technical College. I have been told that the law is changing and I need to register these properties with the Local Authority. Is this correct?

A. Possibly. Mandatory licensing will be introduced on 6 th April 2006. However, this affects only houses in multiple occupation which meet the following criteria:

v The property has three or more storeys (this would include a habitable attic or basement).

v The property has five or more tenants who form two or more households. A family of 7 would constitute only one household and therefore would not require licensing.

If the above applies to your properties then you must apply for a licence within 3 months of 6 th April 2006. If you do not register you will be liable to prosecution and a fine of up to £20,000. Furthermore, the Local Authority can seek an order from the court that any rents and/or housing benefits paid whilst the property was not registered be repaid to the relevant local authority or tenant. It is therefore vital that any landlords' who think they may be affected seek advice.
