Q. I broke my arm in an accident at work last week through no fault of my own. Whilst out shopping with my wife afterwards, a man from a "Claims Management Company" approached me in the high Street and said that he could arrange to bring a claim against my employer for compensation. Are they qualified to do this ?
A. No, but then again they don't need to be. What they do is obtain details of accidents from members of the general public and then "sell" the claim on to a solicitor. At present, claims handlers are unregulated and unlicensed and if you were thinking of signing an agreement with such a company then we would recommend that you check the paperwork very carefully to see precisely what expenses and charges you might be agreeing to.
Q Can I use my own solicitor?
A You are free to appoint any solicitor you want. However, if you have
already signed up with the Claims Management Company they will refer
you on to a solicitor who is on their panel. Often these solicitors are
based in Leeds, Manchester or Birmingham and this can make
communication extremely difficult.
